SEVIERVILLE, Tenn. — A dispute over the height of a flagpole in Sevierville quickly became an online clash over patriotism, free expression and "basic human decency" following an online uproar. Sevierville leaders released a statement Thursday after it said city staff received calls and emails that brought an RV dealer's freedom of expression into question.
In that statement, the city said Camping World was "well aware of the 44-foot maximum height restriction for non-building structures" before it built a 130-foot flagpole and began flying a large American flag. On social media, its CEO shared a letter from the city's Department of Code Enforcement that told the company it could not legally build the flagpole.
The letter was dated Jan. 30. It said a request for a variance to build the 130-foot flagpole was denied in February 2024, because the property was in an Arterial Commercial zone which limits the maximum height of structures other than buildings to 44 feet. The letter told the company it had 30 days to remove the flagpole before the city could start seeking legal action or citing the company.
Marcus Lemonis, the company's CEO, said on social media Tuesday, "The flag and flag pole aren't coming down." He also said, "We are excited to continue to send all the new tax revenue from the 20 million dollar facility we built in your town on former farmland."
The post was shared widely and Sevierville said it was aware of concerns shared online about the city's ordinances and enforcement. The city also said that while it respects and values the right to free expression, it believed "targeting a city employee who is simply carrying out their job is neither patriotic nor productive."
"The situation is a publicity stunt used for advertising and marketing aimed at drawing attention to the business rather than fostering meaningful change," the city said.
The statement said the company built the flagpole despite its request for a variance being denied. The city also emphasized that it had never questioned whether the company could legally fly an American flag. It said other businesses had previously applied for similar variances and had been denied, but those businesses decided to comply and work with the city.
"Let us be clear: the City of Sevierville is not, and never will be, against patriotism. True patriotism embodies respect for the values that unite our community—freedom of expression, responsibility, and civil discourse. Publicly attacking an employee for enforcing regulations is not a reflection of patriotism but a failure of basic human decency. Our employees do not create ordinances; they implement policies established by the organization. They deserve our protection and respect," the city said.
Camping World has until March 1 to remove the flagpole, or otherwise comply with the city's rules, before it could face legal repercussions.

Camping World was well aware of the 44-foot maximum height restriction for non-building structures prior to constructing the 130-foot flagpole. The Board of Zoning Appeals reviewed a request to deviate from the 44-foot height restriction and denied it. Despite the denial, Camping World proceeded with the construction of a flagpole that significantly exceeds the 44-foot height limit as a blatant disregard for that decision and our local ordinances. The ability to display an American Flag was never in question.
It’s important to note that other local businesses have applied for similar variances related to tall structures, including flagpoles, and have been denied in accordance with the same regulations (there are structures located just outside the City limits that exceed 44 feet). These businesses have complied with the rulings and worked collaboratively with the City, demonstrating an understanding of the greater community’s needs. We appreciate their cooperation and believe this collaborative spirit is key to Sevierville’s growth and success.

Camping World CEO Marcus Lemonis told 6 News that they will not be taking it down.
“It breaks my heart, but I will have to tell you and the rest of the town, flag’s not coming down,” Lemonis said.
According to The City of Sevierville, the board of zoning appeals denied Camping World’s request to construct a 130-foot flagpole on their property last year. However, the company proceeded with its development.
“I’ve had this flag in my family, since I was a little child. I was born in a foreign country, I had the blessing of being here in the United States where I can have a business and have employees,” said Lemonis. “This is my way to pay respect, not only the veterans of this country, but current and active military, and everybody else who just loves the country.”
Despite exceeding the city’s 44-foot height limit for the Arterial Commercial (AC) zone the business is zoned for, Lemonis said it not a safety concern.
“I hope that everybody in the community understands this is a principle more than anything. It’s not hurting anybody. It’s been cleared with the FAA, so there’s no safety issue,” he said.
Many residents in the area say they don’t mind the size of the flag.
“I say leave it alone. So it’s big. Let it fly,” said Kodak resident Wilma Snyder.
Veterans driving through also said they see it as a symbol for what they fought for.
“It represents our country, and it represents everybody that fought for this country, and it’s our independence,” said Crossville resident and retired veteran Jeff Renshaw. When asked about the idea of removing it he said, “that’s absolutely the worst thing you could possibly think about doing.”
The City of Sevierville said if the company does not comply in 30 days they will seek legal action or issue citations until they do, but Lemonis is standing firm.
“I understand this is a bone of contention. I understand that we’re going to get fined. I understand that the city has rights to do a lot of things but the flag, it’s not coming down,” he said.
He said nearly all the Camping World locations have a flag just like it. This is not the first time Camping World has been in dispute with a local government. The company has several fines in Greenville, North Carolina for a similar issue over their flags.

SEVIER COUNTY, Tenn. (WVLT) - On Tuesday, Camping World CEO Marcus Lemonis shared a notice from the City of Sevierville regarding a flag pole that displays the giant American flag at the location in Kodak.
Lemonis said the location has a 130-foot flagpole that flies an American flag measuring 40 x 80 ft.
However, the City of Sevierville says this is in violation of the Municipal Zoning Ordinance.

The notice goes on to say that the property may not continue to use the flagpole, adding that Lemonis has 30 days to bring the property into full compliance.

The notice also mentions that a request to construct a 130-foot flagpole was denied in February 2024.

There, the company is being fined $250 a day because the flag is nearly 15 times bigger than the allowable flag on non-residential property in the city and the flagpole is nearly twice as tall as what’s allowed.
In a post on X in response to the violation notice from the city, Lemonis wrote: “The flag is not coming down. You can fine me all you want City of Greenville North Carolina. #NoAmericanFlagIsTooBig”
WVLT News reached out to the City of Sevierville for a statement, and a representative provided the following:
In February 2024, Camping World submitted a variance request to exceed the 44-foot maximum height restriction for non-building structures in order to construct a 130-foot flagpole. The Board of Zoning Appeals reviewed the request and denied it. Despite the denial, Camping World proceeded with the construction of a flagpole that significantly exceeds the 44-foot height limit.
On January 30, 2025, upon discovering the unauthorized construction, the City issued a notice of violation to Camping World. The notice provides a 30-day period for the company to bring the flagpole into compliance with the City’s zoning ordinance.
